Operator: Lotustay Exchange, Inc. · admin@lotustay.com (the privacy contact for Lotustay Exchange, Inc.)
This notice explains how Lotustay Exchange, Inc. ("Lotustay," "we"), which runs Lotustay Exchange and is responsible for member data, handles consumer health data on Lotustay Exchange, including under Washington's My Health My Data Act and similar laws in Nevada, Connecticut, and other states. It adds to our Privacy Policy. If the two differ about consumer health data, this notice controls.
What we collect
Lotustay Exchange doesn't ask for medical records, diagnoses, steps, heart rate, sleep tracking, weight, body photos, or data from fitness trackers or health apps. But some things you choose to share could show something about your health. These include:
Lotus Peace promises. What you write or pick as your daily promise (for example a walk, yoga, an early night, or a meal you cook), whether you kept it, and your private weekly recap.
Health trades. Listings, offers, and messages about health-related trades, like a yoga class or a running buddy.
Wellness & Practice. Wellness & Practice offers you post, view, or accept. We don't sell this activity, share it for advertising, or use it to guess anything about your health.
Daily Sit time. How long you sat. If you use the camera check, only whether a face was in frame and for how long. Your video and face data never leave your device. The Daily Sit is part of Lotustay Garden. If you agree to the Lotus Peace sit notice, your completed sits can also add to your Lotus Peace.
Lotus Peace start. The date your Lotus Peace started and what started it (Lotustay Garden, a Daily Sit, or a promise).
Lotustay Garden activity. While you're in the 3D Lotustay Garden scene, which activity your avatar shows (meditate, read, yoga, or exercise). It's shown to other Members there. If you agree to the Lotus Peace sit notice, we also save which activity you were in, for how many minutes, and how many seconds a face was in frame, so it can add to your Lotus Peace. We check that you're there, not what you're doing, and we don't track your movements. Your video and face data never leave your device.
Anything else you type. Please don't add medical details to promises, listings, or messages.
Where it comes from
Only from you, when you use Lotus Peace or the Exchange. We don't buy health data or get it from other companies.
How we use it
Only to run the features you asked for: to show your promises and recap to you, send reminders you turned on, show trades you post to the members you trade with, count your Daily Sit time, and, if you agree to the Lotus Peace sit notice, add your sits and Lotustay Garden activity time to your Lotus Peace. We also use it as needed to keep the Exchange safe, stop fraud or abuse, and follow the law.
We never:
sell your consumer health data;
use it for ads, ad targeting, or marketing profiles;
share it with other companies for their own use;
use it to train outside AI models; or
use your location to track you near health care places.
Who we share it with
Service providers that host, store, or send data for us (like cloud hosting and email delivery), only under contracts that let them use it just to serve Lotustay. You can ask us for the list.
Other members, only for what you choose to post. Your promise text and weekly recap are never shown to other members. If you choose a Practice Partner, your partner sees whether you made and kept a promise each day, never what it says.
Authorities, only when the law requires it, or to protect someone's safety.
We have no affiliates that receive consumer health data.
Your choices and rights
You can:
see, change, or delete any promise or all your promise history in the app, any time;
turn reminders and the weekly recap off in Settings;
turn off the face check anytime, or turn off the Lotus Peace sit notice in Settings. We stop saving that time for Lotus Peace right away. Lotus Peace you already earned stays;
hide your Lotus Peace in Settings, stop it, or ask us to delete it;
ask us whether we have your consumer health data, for a copy, and for the list of anyone we've shared it with;
ask us to delete your consumer health data;
withdraw any consent you gave. Some features may stop working if you do.
by contacting admin@lotustay.com, the privacy contact for Lotustay Exchange, Inc., which is responsible for this data.
To make a request, email admin@lotustay.com with the subject "Health data request" from the email on your account. We may need to confirm it's you. We'll answer within 45 days. If we need more time, we'll tell you why, and we won't take more than another 45 days. We won't charge you, and we won't treat you differently for using your rights.
Appeal. If we turn down your request, you can appeal by replying with the subject "Health data appeal." We'll answer in writing within 45 days. If you're still not satisfied, you can contact your state attorney general (in Washington: atg.wa.gov).
How long we keep it
We keep your promise history while your account is open, unless you delete it sooner. When you close your account, we delete your promises and recap within 30 days, along with your Lotus Peace record (when it started, what started it, and which days added to it). We keep Daily Sit time and Lotustay Garden activity records (activity, minutes, face-in-frame seconds, and your consent record) with your other club activity records while your account is open, and you can ask us to delete them anytime. Backup copies are erased on their normal schedule, usually within another 90 days. We may keep a record that a request happened, without the health details.
Security
Only staff and service providers who need it to run Lotus Peace can access it, and we protect it with reasonable safeguards like encryption and access controls.
Changes
If we change this notice, we'll post the new version here and update the date. We'll ask for your consent before using consumer health data in a new way that needs it.
